Summary, etc. |
Articles 29 to 51A<br/>This volume looks at the fundamental rights of the minority communities (Articles 29 and 30) entrenching the secular credentials of the Preamble, property rights in the repealed Article 31 and to the extent they still exist as fundamental rights, to allay the fears of the minorities | {Article 30(1 A)}, as well as a constitutional right (Article 300A) since the Forty-fourth Amendment of the Constitution in 1978. This volume also looks at the fundamental right to approach the Supreme Court for relief against violation of any fundamental right (Article 32). We also look at the Constituent Assembly Debates, the Lok Sabha Debates on the Fiftieth Amendment of the Constitution and judgments of the Court on whether and to what extent the fundamental rights are not enforceable by the members of the Armed Forces and the logic behind these special provisions for citizens who defend our country (Article 33).Thereafter we look at Articles 34 and 35, dealing with restriction of fundamental rights while martial law is in force in any area and, legislation to give effect to the rights contained in Part III, respectively. This volume also covers the Directive Principles laid down in Chapter IV of the Constitution (Article s 36 to 51 ). As we turn to this Chapter, we discover that the Directives are the most dynamic force not not only with regard to the policies to be followed by the State but their role in interpreting the fundamental rights. The socialist dimension of the Directives is forcefully articulated in the debates but compulsion of economics has driven the political class to find ways and means to migrate to market design. Maybe the makers did not anticipate the drastic changes brought about by international factors within 30 years of the adoption of the constitution. Finally, we look at the Fundamental Duties in Part IVA (Article 51 A) which were insertrd. Finally, we look at the fundamentals duites in Part IVA (Article 51A) which were inerted by the Forty-second Amendment of the Constitution.the Forty-second Amendment of the Constitution. ---Lawbookshop.net |
