The enactment of the Consumer Protection Act is regarded as'magna carta' in the field of consumer protection for checking the unfair trade practices and deficiency in goods and services. The importance of the Act lies in promoting the welfare of society by enabling the consumer to participate directly in the market economy. The Indian Parliament enacted the Consumer Protection Act, 2019 on 9 August 2019, which came into effect from 20 July 2020, repealing the Consumer Protection Act, 1986, to provide for timely and effective administration and settlement of consumers' disputes. While retaining certain old provisions, the New Act has some new provisions, like e-commerce, the establishment of the Central Consumer Protection Authority (CCPA), strict norms for misleading advertisement, strict norms for product liability, and alternate dispute resolution through mediation, to further safeguard consumer rights and create an exhaustive consumer protection law. As per the Act, the expression 'buy any goods' and 'hires or avails any services' includes offline or online transactions through electronic means or by teleshopping, direct selling, or multi-level marketing. With arduous industry, dedication, and devotion, an earnest attempt has been made by the authors to undertake extensive research on various provisions of the enactment and its effectiveness in dealing with cyber crimes. Five editions of the 'Commentary on the Consumer Protection Act, 1986' by the authors received overwhelming responses from the bench, bar, and all those who have to deal with this legislation, and the reviews of the book bear testimony that the book enjoyed the reputation of a standard and reliable commentary on the subject. ---provided by publisher |
